  • Made a free video for a brand, now they’re using it in paid ads everywhere

I’m newly an influencer I guess (16k followers) and my first partnership with a brand was done a few months ago when I knew nothing about how much people get paid to do this stuff.

I thought getting free product was good for my first partnership. No contracts were signed, it was very low key, but I worked hard on the video and it was for a pretty well known brand in the space I’m in (240k followers).

Now I’m seeing the video I made being used as an ad everywhere without any mention of my page. I’ve already seen it 3 times on instagram and once on Facebook in the span of a week.

Since making the video I’ve worked with large and small brands who actually pay and learned a lot about how much people charge for whitelisting, usage rights, and for ads.

Considering how much they’re pushing the video, it’s clear they’ve spent a lot of money on advertising. I could’ve made a nice amount from that had I known better. At the very least they could’ve pushed the video from my page. Instead they downloaded it from instagram somehow and reuploaded it as an ad.

Is there is anything I can do here or do I call it a lesson learned? The thought of them owning it in perpetuity feels unfair. Although I never signed or was given a contract, the brief said:

    Usage:
    – Social Media (Organic + Paid including but not limited to whitelisting, and spark ads)
    – Website, and Email
Digital/internet (Brand owned and operated website and email marketing)

To be clear, you created a video for free product and were provide a brief that said in return they could use it for organic + paid social media usage and web + email marketing. Correct?

That’s a really tough lesson to learn the hard way. And this is a great post for new people to see so they don’t make the same mistake. I’m sorry this happened to you and I’m sorry this brand took advantage of you this way. But it sounds like what’s done is done and you’ve learned what not to do.
