How are those who are based in Europe dealing with tracking and GDPR? Do you have any tips for maximising consent?

In general, understanding the discrepancies between the internal data and your analytics tool is key. The ecom I work for has a discrepancy of around 15% on their sales figures, so its not a criticql data loss, but still not ideal ofc. But try to keep this in mind when analyzing KPI:s like roas, CPA etc

For Google Ads, you can always try out using enhanced conversions or even consent mode, but those are both kind of a gray area If its okay to use or not. So I think it’s reasonable to discuss what’s allowed or not with your legal department

My experience though is that its unclear for many businesses what’s legal or not according to GDPR, which complicates things for sure

    Hey so:

Be Transparent: Be open and honest with your users about how their data will be collected, used, and stored. Clearly explain your data practices in simple language and make your privacy policy easily accessible.

Obtain Explicit Consent: Ensure that users actively and explicitly opt-in to data collection and tracking. Avoid using pre-ticked checkboxes or any form of implied consent. Make it clear what users are consenting to and give them control over their choices.

Offer Granular Options: Provide users with specific choices to consent or opt-out of different types of data processing and tracking activities. This empowers individuals to decide what they are comfortable with and allows for more targeted consent.

Use Clear Cookie Consent: Implement a cookie consent banner that clearly informs users about the types of cookies used and their purposes. Give users the ability to accept or reject cookies and easily manage their preferences.

Provide Preference Centers: Offer users a dedicated preference center where they can manage their consent settings and update their preferences easily. This allows individuals to have more control over their data and builds trust.

Educate and Inform: Provide clear information and educational resources about data protection and privacy practices. This can include FAQs, video tutorials, or blog posts that explain how you protect user data and comply with GDPR.

Regularly Review Consent Mechanisms: Keep your consent mechanisms up to date and regularly review them for compliance. Stay informed about changes in GDPR regulations and adapt your practices accordingly.

Ensure Third-Party Compliance: If you use third-party services for tracking or data processing, ensure they are also GDPR compliant. Review their privacy policies and data processing agreements to align with your obligations.
