    I don’t know if my question is clear enough. English is not my first language, so let me elaborate it with examples.

    For instance, as a fan of football (soccer), I follow the Instagram account of Chelsea fc. Every weekend (back then before the pandemic happens), they always post a matchday poster (that contain the squad’s starting line up) with different themes.

    They used Netflix reference, Starwars reference, and many other references (you can see on their story highlights). My question is, do the social media team has to ask permissions to the IP owner before they make that design? Or is it okay since they did not explicitly put the logo on their Insta Story visuals?

    What is the limitation on this? And can I do the same for my brand? (Creating Insta Story content design that has similar vibes with famous brand)

    I think it depends on the brand. There are assets that are protected by copyright but you can still refer to them if you slightly change them (like official facebook emojis for example. you can’t use the specific arts for the emojis but you can “hack” your content to the point that the audience knows what you’re talking about but you’re not using the official assets) and there are some products/brands that are very strict when it comes to referring to them (like the olympics for example, that have a set of “official” words that you can’t use on your content).
    However, if it’s a very small brand that’s referring to a huge brand, usually the huge brand don’t bother suing the small brand because the exposure is somehow irrelevant. But it really depends on the brand and how protective they are.
