Misrepresentation is a general GMC policy violation and is not specifically tied to opting into shopping ads. So in theory if you are meeting policy requirements for free listings you are also meeting policy requirements for shopping ads. I will say anecdotally I think if you are running ads your account is subject to more scrutiny so if you are just flying under the radar but are indeed breaking policy, you could get flagged when you start running ads. The vast majority of above board business running Google ads are not running into misrepresentation claims. If you are selling something virtual (downloads, product keys, etc.) that does seem to be an area that gets hit with these more frequently but hard to say without knowing your business.
